Also, what if qualifying for that status becomes a way for tech companies to get the final say on who is and isn't a news organization and lock out new entrants they don't like?

The longer any monopoly-style company exists the more their actions are explainable as 'preserving their dominance and control of the marketplace' because their systems continually become less capable of profit without that monopoly advantage.
